Tax avoidance via tax havens under scrutiny: investigations in North Rhine-Westphalia are gathering pace
The fight against tax crime is entering a new phase in North Rhine-Westphalia. The State Office for Combating Financial Crime (LBF NRW) and the Specialised Public Prosecutor’s Office for Economic Crime in Bochum have announced that they are moving the analysis of leaked offshore data into the „critical phase“.
The focus is on complex schemes involving so-called tax havens, which are alleged to have been used to shield substantial assets from taxation. The criminal tax investigation is now getting under way – and the first searches have already taken place in North Rhine-Westphalia.
What exactly is this about?
- The accused are alleged to have used offshore companies in traditional tax havens, such as the Caribbean or the Far East, to hide their assets from the German tax authorities.
- The investigations are based on extensive data leaks that reveal international business links and financial flows.
- The information gathered is currently being analysed by the LBF NRW by a team of around 1,200 specialist investigators.
- The Bochum Public Prosecutor’s Office, known for the „tax CD case“, is leading the criminal proceedings.
What does this mean for taxpayers?
The message is clear: the authorities are stepping up the pressure on opaque asset structures abroad. Through international cooperation, data analysis and growing technical expertise, they are becoming increasingly successful at uncovering even supposedly discreet arrangements.
This may affect not only obvious „tax evaders“, but also people who have used financial products abroad in good faith – without being aware of the tax risks.
Our advice: Take action – before others do
Anyone who may be affected – whether through their own foreign bank accounts, shareholdings in offshore companies or opaque tax arrangements – should take action before any investigations are launched.
In many cases, it is still possible to make a voluntary disclosure that results in immunity from prosecution, but this requires legal and tax expertise.
